The Maryland legislature approved the most stringent state privacy law to date and is set to become the most restrictive state law passed to date with regards to sensitive data, minors' privacy, data minimization, and unlawful discrimination. Additionally, by setting the compliance threshold so low – small companies will be required to comply with its provisions. The Maryland Online Data Privacy Act of 2024 (“MODPA”) law, if signed by the governor, will take effect on October 1, 2025.
Threshold - This law applies to businesses or individuals who either controlled or processed personal data of 35,000 consumers, or controlled or processed personal data of at least 10,000 consumers and derived more than 20% of their gross revenue from the sale of personal data in the prior calendar year.
