FTC Staff Reminds Influencers and Brands to Clearly Disclose Relationship

On April 19, 2017, the Federal Trade Commission (“FTC”) announced they issued over 90 letters to social media influencers and brands, reminding them of the requirement to clearly disclose any material connections when promoting products on platforms like Instagram. This outreach, prompted by petitions and reviews of Instagram posts, highlights the importance of making such disclosures prominent, especially given that mobile users often see only a portion of longer posts. The FTC's Endorsement Guides mandate that any significant relationship—such as financial incentives or personal connections—should be explicitly stated to ensure transparency and credibility in endorsements.
