Who Enforces Alabama’s Privacy Law?

The Alabama Attorney General enforces the APDPA. The statute does not create a private right of action for consumers.
Before initiating an enforcement action, the Attorney General must provide notice and a 45-day opportunity to correct the violation. A controller that cures the violation and provides the required written assurances can avoid an action under that provision. Uncorrected violations may lead to an injunction and civil penalties of up to $15,000 per violation. The cure provision has no stated sunset date.
